Shortly after the US appeals court temporarily lifted the sales ban on Apple Watch Series 9 and Ultra 2, the company resumed sales.

While the devices are being placed back on store shelves at Apple Store locations today, the company announced that online sales will not resume until 3 p.m. Eastern time on Thursday.

The pause on the sales ban was granted by a US federal appeals court at the request of Apple. That provision will remain in effect while U.S. Customs authorities evaluate whether a software update from Apple will eliminate medical device maker Masimo’s alleged infringement of blood oxygen saturation patents.

This will be decided on January 12, so the Apple Watch models in question will remain on sale at least until then.

Masimo and the U.S. International Trade Commission (which decided on the initial import ban and sales ban) believe the breach was hardware-related and therefore could not be resolved by adjusting the way data is collected by the watch beyond the sensor.

An Apple spokesperson said Border On Wednesday: “Apple’s teams have worked tirelessly for many years to develop technology that provides users with industry-leading health, wellness and security features, and we request that the U.S. Court of Appeals for the Federal Circuit postpone the order pending our full appeal.”

If Apple loses its appeal and the import and sales ban remains, there’s no word on what the company will do to get the devices back on sale in the United States, other than changing the technology inside the hardware component to respect Masimo’s IP.

This may be a difficult question at this stage in the development of the Apple Watch Series 9 and Ultra 2. Apple may have to license the technology in question in order to put the devices back on sale in a timely manner. This will probably require a large sum of money. Or there may even be a scramble to make the necessary changes to the sensor in time for potential Apple Watch hardware upgrades in 2024.
